This letter is in regards to a temporary child support order that was established by the D.O.R. and Polk County Court without supporting documents (CHILD SUPPORT ENFORCEMENT) while still in court proceedings. After several attempts trying to resolve this error I have no choice but to write about it, I was told this is a state issue, but its also a federal issue. All avenues were already taken in this matter and everyone is passing the buck.
The D.O.R used false financial information in this cause and Mr.Scarlato was granted his motion to compel discovery Several Contempt Motions were filed there after for discovery and visitation with his daughter
As a result of this error the financial affidavits are far less than what was submitted by the D.O.R and being ignored for correction. The Wife received child support that was paid directly to her through a settlement agreement that was ordered by the court and received as child support. I have all the documents as well as all responses on the 6th paragraph of this letter (THEY DO NOT CARE).
This was a temporary child support order with no discovery, no financial affidavits and no income verification that did not go through the D.O.R. The Wife received temporary child support to be paid directly to her as ordered by the court and then denied she received money there after.
If proper Family Law rules of Civil Procedures were followed in according with the very laws that govern the State of Florida, WHICH CANNOT BE WAIVED BY EITHER PARTY pursuant to F.S. 61.30 and FL Chapter 61 this error would have never happened. Providing false and misleading information to the court is a felony, punishable by fines and imprisonment, why should the department of revenue be excused from such an error, does the term second look mean anything!
I have contacted Governor Charlie Crist, Senator Bill Nelson, Puala Dockery, State Representative John Wood, member of Congress Adam .H. Putnam, Attorney General Bill McCollum, who represents the D.O.R, Dianne Offett, Chief Public Inquiries and information of Child Support Enforcement, as well as the Executive Director of D.O.R Lisa Echeverri, and many other State and Government agencies, who refuse to accept accountability for this error which they have created. Are these the people you really want to Represent or Govern the State of Florida, or for that matter in any position of any importance in any State, this is total negligence.
This is in response to Janit Spohn who is trying to pass the D.O.R error on to MR Scarlato as blame when the representing attorney for Miss Scarlato submitted this order assuring through a personal letter that it was correct, however, HE DOES NOT CARE ABOUT EXCUSES, MR Scarlato preserved his standing with the Court through his objection, and his wages were Tran scripted and signed for certified mail return receipt requested on 9-20-2007- 12-26-2007-1-15-2008-2-15-2008 BY THE ATTORNEY as well as his financial affidavit submitted on 12-19-2007 TO THE COURT this error was intentional, the State Of Florida, and the D.O.R must be held accountable for this error, from a political stand point this does not look good THE STATE OF FLORIDA DOES NOT NEED THESE ERRORS TO EXIST. This information will be posted on the internet for everyone to view asking the public to petition this letter against fraud committed by government and state agencies and its political figures that I have mentioned.

D.O.R. (Department of Revenue) This is a problem when this Dept will not look at all the facts before having an agreement. They must set a review date or court date to fix this problem. At their expense because of their mistake . I do know hands on about this Dept. because I have delt with them for 16 years myself, with problems the whole time. They are not doing there job corectly. Before setting an order they need to get all facts straight.
ReplyDeleteMichael, the abuse you are taking from these elected officials is absurd. I can't wait to vote against them all. I bet if you were a big donor that contributed lots of money to their campaign your issue would be resolved. The Attorney General is a political hack that hopefully after the election is out of government for good!
